Terms of service

1. Who we are and what this site is

Clubmembers.net (“the Site”) is operated by The Member Network(“we”, “us”). We assemble member benefit programs for organizations — credit unions, banks, associations, employers, and membership clubs — and make them available to those organizations to offer to their own members or employees.

For some programs we contract with you and bill you directly. For others we introduce a third-party provider who contracts with you directly; in that case the provider’s own agreement governs that program and we are not a party to it.

2. What is insurance and what is not

The travel portal, everyday discounts, the wellness app, roadside assistance, and identity and credit monitoring are membership benefit programs and are not insurance.

The affinity program is insurance, underwritten by the issuing carrier and subject to underwriting and state availability. A disclaimer applying to one program does not apply to another. See our disclaimer.

3. Subscriptions, billing, and automatic renewal

The travel portal is sold as a subscription, billed annually or monthly, plus a one-time setup fee of $495 charged in full with your first invoice.

  • Authorization. By completing checkout you authorize us to charge your payment method for the subscription fee and the setup fee, and for each renewal term thereafter.
  • Automatic renewal. Subscriptions renew automatically at the end of each term at the then-current rate, until cancelled.
  • Cancelling. You may cancel at any time from your group dashboard or by emailing team@clubmembers.net. Cancellation takes effect at the end of the current term. We do not require a phone call to cancel.

  • Price changes. We may change subscription pricing effective at your next renewal, with notice before that renewal. Continuing after the notice period is acceptance of the new rate.
  • Taxes. Amounts shown exclude any applicable sales or use tax, which may be added where required.

The online checkout is offered to groups up to 10,000 members. We may decline or refund a purchase made outside that range.

4. Quote requests and consent to be contacted

When you submit a quote request, contact form, or callback request, you ask us to contact you about member benefit programs. Where you check the consent box, you agree we may contact you by email, phone, or text, including by automated means. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts.

5. Your obligations as a sponsoring organization

  • You may use provider-supplied marks and materials only as permitted for the program.
  • You are responsible for the accuracy of the member count you give us, which is what programs are priced against.
  • You may not resell a program outside the terms of the agreement covering it.
  • You are responsible for any member data you supply to us or to a provider, and for having the right to supply it.

6. Acceptable use

Do not attempt to interfere with the Site, access it by automated means beyond ordinary search indexing, probe it for vulnerabilities without written permission, or use it to send unsolicited messages.

7. Intellectual property

The Site, its text, design, and graphics are ours or our licensors’. Provider marks belong to those providers. Nothing here grants you a license to any of it beyond what is needed to use the Site and any program you have purchased.

8. Third-party programs and links

Programs are delivered by third parties. We do not control their systems, pricing, or service levels, and their agreements and privacy practices govern their programs. Where a provider contracts with you directly, disputes about that program are between you and the provider.

9. Disclaimers

THE SITE AND THE PROGRAMS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PARTICULAR SAVING, RATE, OR RESULT WILL BE ACHIEVED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify us against claims arising from your use of the Site, your breach of these terms, or your distribution of a program to your members.

12. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. We may update these terms. Material changes affecting a paid subscription take effect at your next renewal.
